On December 14, 1960, the General Assembly adopted Resolution 1514 (XV), "Declaration on the Granting of Independence to Colonial Countries and Peoples," which proclaimed "the necessity of putting a speedy and unconditional end to colonialism in all its forms and manifestations," enshrining two fundamental principles that were to guide decolonization: self-determination and territorial integrity.
The principle of self-determination is not applicable c level executive list to the Question of the Malvinas Islands. The specificity of the Malvinas Question lies in the fact that the United Kingdom occupied the Islands by force in 1833, expelled their native population, and did not allow their return, thereby violating Argentina's territorial integrity. The possibility of applying the principle of self-determination is therefore ruled out, since its exercise by the inhabitants of the islands would cause the "disruption of the national unity and territorial integrity" of Argentina. In this regard, it should be noted that Resolution 1514 (XV) "Declaration on the Granting of Independence to Colonial Countries and Peoples" establishes in its sixth paragraph that "Any attempt aimed at breaking, in whole or in part, the national unity and territorial integrity of a country is incompatible with the purposes and principles of the Charter of the United Nations."
In the Malvinas Question, the United Nations General Assembly adopted this doctrine - of applying the principle of territorial integrity by referring to the interests and NOT the wishes of the population of the Islands - in its resolution 2065 (XX) of 1965, subsequently ratified by other resolutions in 1973 (3160, XXVIII), 1976 (31/49), 1982 (37/9), 1983 (38/12), 1984 (39/6), 1985 (40/21), 1986 (41/40), 1987 (42/19) and 1988 (43/25). They all declare the existence of a sovereignty dispute and reaffirm the invitation made in resolution 2065 (XX) to the Parties (Argentina and the United Kingdom) "to continue without delay the negotiations recommended by the Special Committee on the Situation with regard to the Implementation of the Declaration on the Granting of Independence to Colonial Countries and Peoples, with a view to finding a peaceful solution to the problem, taking due account of the provisions and objectives of the Charter of the United Nations and of Resolution 1514 (XV), as well as the interests of the population of the Malvinas Islands."
