Artificial Intelligence and Copyright: Italian Bill

Comparison of the Italian draft law on the use of works in the process of generating AI objects with the Ukrainian law on copyright and related rights

On May 20 of this year, Bill No. 1146 on the provisions on artificial intelligence was presented to the Italian Senate . This bill amends, in particular, the Italian law on copyright and related rights ( Law of April 22, 1941, No. 633 ).

The amendments to the Italian law on copyright and related rights are contained in Article 24 of the draft law ( PDF ), this article has two paragraphs:
1. paragraph “a)” – amendments to Article 1, which clarify that all works must be created by a human being, and also complement the article with the provision that works may be created using artificial intelligence tools, provided that they are the result of human intellectual activity.
